By accessing our website, requesting a quotation, purchasing services, or continuing to use our services, you agree to these Terms. If you do not agree with these Terms, please do not use our website or services.

GNet Web Solutions may update these Terms from time to time. The latest version will be published on this page.

2. Definitions

In these Terms:

• “GNet Web Solutions”, “we”, “us”, or “our” refers to GNet Web Solutions.
• “Client”, “you”, or “your” refers to the person, company, or organisation using our website or services.
• “Services” refers to website design, web hosting, domain registration, email hosting, digital marketing, technical support, maintenance, and related services provided by GNet Web Solutions.
• “Website” refers to https://gnetweb.co.za and any related pages or online platforms operated by GNet Web Solutions.

3. Services

GNet Web Solutions provides digital and technical services, which may include:

• Website design and development.
• Web hosting and server-related services.
• Domain registration and management.
• Email hosting and configuration.
• Website maintenance and support.
• Search engine optimisation, digital marketing, and related online services.

Specific service details, deliverables, pricing, timelines, and responsibilities may be set out in quotations, invoices, service agreements, proposals, or support communications.

4. Quotations and Orders

Quotations are valid for the period stated on the quotation. If no validity period is stated, quotations are valid for 14 days from the date of issue.

A quotation does not constitute a binding agreement until accepted by the client and confirmed by GNet Web Solutions. We reserve the right to correct errors, revise pricing, or withdraw a quotation before acceptance.

Additional work outside the agreed scope may be quoted and charged separately.

5. Fees and Payment

Clients agree to pay all fees, invoices, deposits, subscriptions, renewals, and charges applicable to the services provided.

Unless otherwise agreed in writing:

• Website projects may require a deposit before work begins.
• Hosting, domain, email, and maintenance services may be billed monthly, annually, or according to the applicable service plan.
• Payments must be made by the due date stated on the invoice.
• Late payment may result in service suspension, delays, or termination.
• Domain registrations, renewals, third-party licences, and hosting fees may be non-refundable once processed.

All prices are subject to change where third-party costs, exchange rates, supplier pricing, taxes, or service requirements change.

6. Client Responsibilities

Clients are responsible for:

• Providing accurate account, billing, domain, and contact information.
• Supplying required website content, images, login details, approvals, and feedback on time.
• Ensuring that any content supplied does not infringe third-party rights or violate applicable laws.
• Keeping passwords and access credentials secure.
• Reviewing and approving work before publication.
• Maintaining backups of any data, files, or content not expressly covered by a managed backup service.

Delays in providing information, feedback, or approvals may affect project timelines and service delivery.

7. Website Projects and Approvals

For website design, development, or redesign projects, the project scope will be based on the agreed quotation, proposal, or written brief.

Once a client approves design concepts, content, functionality, or final delivery, further changes may be treated as additional work and billed separately.

GNet Web Solutions is not responsible for delays caused by late content, incomplete information, third-party services, domain issues, client-side changes, or delayed approvals.

8. Hosting, Domains, and Email Services

Hosting, domain, and email services depend on third-party infrastructure, registrars, networks, and software providers.

While we take reasonable steps to provide reliable services, we do not guarantee uninterrupted, error-free, or completely secure operation.

Clients are responsible for renewing domains, hosting, email, and related services by the due date. Failure to renew may result in suspension, expiry, loss of domain rights, data loss, or service interruption.

Domain registration and renewal are subject to registrar rules and availability.

9. Acceptable Use

You agree not to use our website, hosting, email, or related services for unlawful, abusive, harmful, or disruptive activities, including:

• Sending spam or unsolicited bulk email.
• Hosting malware, phishing pages, scams, or fraudulent content.
• Infringing copyright, trademarks, or other intellectual property rights.
• Uploading illegal, defamatory, hateful, or harmful content.
• Attempting to gain unauthorised access to systems or data.
• Interfering with the security, performance, or availability of our services.

We may suspend or terminate services where we reasonably believe there has been a breach of acceptable use requirements.

10. Third-Party Services

Our services may rely on or integrate with third-party providers, including hosting platforms, registrars, plugins, software, payment processors, analytics tools, marketing platforms, and content management systems.

Third-party services are subject to their own terms, pricing, availability, privacy policies, and service limitations. GNet Web Solutions is not responsible for outages, policy changes, price increases, data loss, or failures caused by third-party providers.

11. Intellectual Property

Unless otherwise agreed in writing, GNet Web Solutions retains ownership of its pre-existing intellectual property, including tools, processes, templates, code libraries, design methods, and internal systems.

Upon full payment of all amounts due for a website project, the client receives the rights to use the final approved website design and content created specifically for the client, excluding third-party assets, licensed software, plugins, stock media, frameworks, and GNet Web Solutions’ pre-existing materials.

Clients must ensure they have rights to use any content, images, logos, text, media, or materials supplied to us.

12. Content and Legal Compliance

Clients are responsible for ensuring that their website content, business practices, products, services, advertising claims, and legal pages comply with applicable laws and regulations.

GNet Web Solutions may assist with website copy, policy page templates, or general content, but this does not constitute legal advice. Clients should obtain professional legal advice where required.

13. Data Protection and Privacy

We process personal information in accordance with our Privacy Policy.

Clients using our hosting, website, email, or digital services are responsible for ensuring that their own collection and use of personal information complies with applicable data protection laws, including POPIA and GDPR where applicable.

Where required, additional data processing terms may apply.

14. Backups and Data Loss

Unless a specific managed backup service is included in your service plan, clients are responsible for maintaining their own backups of website files, databases, emails, content, and business data.

Although backups may be performed as part of certain services, we do not guarantee that any backup will be complete, current, or recoverable unless expressly agreed in writing.

GNet Web Solutions is not liable for data loss caused by client error, malware, third-party failures, expired services, unpaid accounts, unauthorised access, or circumstances beyond our reasonable control.

15. Service Suspension and Termination

We may suspend or terminate services if:

• Fees are unpaid or overdue.
• The client breaches these Terms.
• The services are used for unlawful or harmful activities.
• Continued service provision creates technical, legal, security, or reputational risk.
• A third-party provider suspends or terminates a related service.

Clients may cancel services by providing written notice, subject to the applicable billing cycle, contract term, or service agreement.

Cancellation does not release the client from paying outstanding amounts due.

16. Limitation of Liability

To the maximum extent permitted by law, GNet Web Solutions will not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, loss of business, reputational damage, service interruption, or third-party failures.

Our total liability for any claim relating to services is limited to the amount paid by the client for the specific service giving rise to the claim during the three months preceding the claim, unless otherwise required by law.

17. Indemnity

You agree to indemnify and hold GNet Web Solutions harmless against claims, damages, losses, liabilities, costs, or expenses arising from:

• Your use of our website or services.
• Content, materials, or instructions supplied by you.
• Breach of these Terms.
• Violation of applicable laws or third-party rights.
• Misuse of hosting, email, domain, or website services.

18. Warranties and Disclaimers

Our website and services are provided on an “as available” basis, subject to agreed service terms.

We do not warrant that the website or services will always be uninterrupted, error-free, secure, or compatible with every browser, device, plugin, platform, or third-party service.

Any estimated timelines are provided in good faith and may be affected by client delays, technical issues, third-party services, or other circumstances outside our reasonable control.

19. Governing Law

These Terms are governed by the laws of the Republic of South Africa.

Any disputes arising from these Terms or our services will be subject to the jurisdiction of the appropriate South African courts, unless otherwise agreed in writing.
